These Terms of Use (hereinafter referred to as "Terms") apply to the LINA.PHOTOS client application and related services (collectively referred to as the "App"). WebGift ("LINA.PHOTOS", "we", "us", or "our") permits you to use the App strictly in accordance with these Terms, for personal, non-commercial, and individual entertainment purposes only.

Before starting to use the App, please read this agreement thoroughly, especially conditions related to waivers or limitations of liability, rights licenses, use of information, applicable laws, and dispute resolution terms. Important provisions, such as those concerning waivers or limitations of liability, are highlighted in bold for your focused attention. If you are a minor, you may only use the App through an account participated by your parent or legal guardian after they have agreed to the terms of this agreement.

Unless you fully accept the entire content of these Terms, you have no right to download, install, use, or in any way access services provided by "LINA.PHOTOS" (referred to as "use" in this agreement). If you proceed to download, install, and/or use the "LINA.PHOTOS" application and/or related services, it is considered that you (i) fully understand and agree to be bound as a party to this agreement, and (ii) agree to the LINA.PHOTOS Privacy Policy available at https://lina.photos/privacy. If you do not agree to these Terms or the Privacy Policy, you must not use the App or services and immediately delete the App from your computer or mobile device.

This agreement includes a mandatory arbitration provision for dispute resolution. You agree that any disputes between you and LINA.PHOTOS will be resolved through binding individual arbitration, and you waive the right to participate in class actions or class arbitrations.

1. Use of Our App

The LINA.PHOTOS App is an online synthetic media application that utilizes artificial intelligence algorithms to create unique content. Initially, you can select images from your device's library or other content libraries (referred to as "Source Directory") to generate content. Then, you may upload images, photos, or drawings in supported LINA.PHOTOS formats based on file size (referred to as "Facial Content"). Upon successful completion of the first two steps, you can click the "LINA.PHOTOS" button or other similar options. The LINA.PHOTOS AI algorithm scans the photo and selected images, identifies faces, and then swaps them with new objects as desired, replacing the image behind the face ("Generated Content"). You can share the generated content with others via social media, email, or other service features, or directly download it to your device.

(1) Eligibility

You may only use the App in compliance with these Terms and all applicable local, domestic, and international laws, rules, and regulations if you are capable of entering into a binding contract with LINA.PHOTOS. Users previously removed from the App by LINA.PHOTOS are not eligible to use the App. To use the App, you must have a compatible device that meets the minimum specifications set by each mobile application store ("App Store") from which the App was purchased. Any compatible device from which you download the App is referred to as "Device" for the purposes of these Terms. You confirm that you own the Device or have obtained permission to install and use the App on the Device if it is not owned by you. Regardless of whether the Device is owned by you or whether you have used such a Device, you are responsible for the use of the App on or in relation to that Device.

(2) The LINA.PHOTOS App

Subject to your strict compliance with these Terms, LINA.PHOTOS grants you a limited, non-exclusive, non-transferable, personal, and revocable license to use the App on your device for non-commercial, personal entertainment purposes only. LINA.PHOTOS reserves the right to terminate this license at its sole discretion at any time. Any material or other information downloaded or used through the App or as part of the related services is limited to your personal entertainment and may not be used for commercial purposes without the express prior written consent of LINA.PHOTOS, at its sole and absolute discretion. Unless explicitly permitted by these Terms, you may not use, copy, modify, adapt, distribute, create derivative works, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, or otherwise exploit the App and related services or content. LINA.PHOTOS grants no rights or licenses to the intellectual property owned or controlled by LINA.PHOTOS, except for the explicitly granted licenses and rights herein.

(1) 자격

귀하는 LINA.PHOTOS와 구속력 있는 계약을 체결할 수 있는 경우에만 본 약관과 모든 해당 지역, 국내 및 국제 법률, 규칙 및 규정을 준수하는 경우에만 앱을 사용할 수 있습니다. 이전에 LINA.PHOTOS에 의해 앱에서 제거된 사용자는 해당 앱을 사용할 수 없습니다. 앱을 사용하려면 앱을 구입한 각 모바일 애플리케이션 스토어("앱 스토어")에서 규정한 최소 사양을 충족하는 호환 장치가 있어야 합니다. 귀하가 앱을 다운로드하는 모든 호환 장치는 본 약관의 목적에 따라 "장치"로 알려져 있습니다. 귀하는 해당 장치를 소유하고 있거나 귀하가 소유하지 않은 경우 해당 장치에 앱을 설치하고 사용할 수 있는 권한을 얻었음을 확인합니다. 귀하는 해당 장치가 귀하의 소유인지 또는 귀하가 그러한 장치를 사용했는지 여부에 관계없이 해당 장치에서 또는 이와 관련된 앱 사용에 대한 책임을 집니다.

(2) LINA.PHOTOS 앱

귀하가 본 약관을 엄격하게 준수한다는 조건으로 LINA.PHOTOS는 귀하에게 비상업적, 개인 엔터테인먼트 용도로 기기에서 앱을 사용할 수 있는 제한적이고, 비독점적이며, 양도 불가능하고, 개인적이고, 취소 가능한 라이센스를 부여합니다. LINA.PHOTOS는 단독 재량에 따라 언제든지 이 라이센스를 취소할 권리를 보유합니다. 귀하가 앱을 통해 또는 관련 서비스의 일부로 다운로드하고 사용하는 모든 자료 또는 기타 정보는 귀하의 개인적인 오락으로 제한되며 LINA.PHOTOS의 명시적인 사전 서면 동의 없이는 상업적 목적으로 사용할 수 없습니다. 유일하고 절대적인 재량입니다. 본 약관에서 명시적으로 허용하지 않는 한, 귀하는 앱 및 관련 서비스를 사용, 복사, 개작, 수정, 배포, 파생 저작물 생성, 라이선스 부여, 판매, 양도, 공개 전시, 공개 실행, 전송, 스트리밍, 방송 또는 기타 방법으로 사용할 수 없습니다. 또는 내용. LINA.PHOTOS는 개인정보 보호법 제30조에 따라 정보주체(고객)의 개인정보를 보호하고 이와 관련한 고충을 신속하고 원활하게 처리할 수 있도록 하기 위하여 다음과 같이 개인정보 처리지침을 수립․공개합니다.

2. 개인정보의 처리 및 보유기간
① LINA.PHOTOS는 정보주체로부터 개인정보를 수집할 때 동의받은 개인정보 보유․이용기간 또는 법령에 따른 개인정보 보유․이용기간 내에서 개인정보를 처리․보유합니다.
② 리나 포토북 제공을 위해 수집한 개인정보는 5년간 보존됩니다.

3. 개인정보의 제3자 제공
LINA.PHOTOS는 정보주체의 별도 동의, 법률의 특별한 규정 등 개인정보 보호법 제17조에 해당하는 경우 외에는 개인정보를 제3자에게 제공하지 않습니다.

4. 정보주체와 법정대리인의 권리․의무 및 행사방법
정보주체는 LINA.PHOTOS에 대해 언제든지 다음 각 호의 개인정보 보호 관련 권리를 행사할 수 있습니다.

① LINA.PHOTOS는 개인정보 보유기간의 경과, 처리목적 달성 등 개인정보가 불필요하게 되었을 때에는 지체없이 해당 개인정보를 파기합니다.
② LINA.PHOTOS는 다음의 방법으로 개인정보를 파기합니다.

- 전자적 파일 : 홈페이지 저장 정보 삭제 처리

7. 개인정보의 안전성 확보조치
LINA.PHOTOS는 개인정보의 안전성 확보를 위해 다음과 같은 조치를 취하고 있습니다.

- 관리적 조치 : 내부관리계획 수립․시행, 직원․종업원 등에 대한 정기적 교육
- 기술적 조치 : 개인정보처리시스템(또는 개인정보가 저장된 컴퓨터)의 비밀번호 설정 등 접근권한 관리, 백신소프트웨어 등 보안프로그램 설치, 개인정보가 저장된 파일의 암호화
- 물리적 조치 : 개인정보가 저장․보관된 장소의 시건, 출입통제 등

8. 개인정보 자동 수집 장치의 설치∙운영 및 거부에 관한 사항
① LINA.PHOTOS는 이용자에게 개별적인 맞춤서비스를 제공하기 위해 이용정보를 저장하고 수시로 불러오는 ‘쿠기(cookie)’를 사용합니다.
② 쿠키는 웹사이트를 운영하는데 이용되는 서버(http)가 이용자의 컴퓨터 브라우저에게 보내는 소량의 정보이며 이용자들의 PC 컴퓨터내의 하드디스크에 저장되기도 합니다.
      가. 쿠키의 사용목적: 이용자가 방문한 각 서비스와 웹 사이트들에 대한 방문 및 이용형태, 인기 검색어, 보안접속 여부, 등을 파악하여 이용자에게 최적화된 정보 제공을 위해 사용됩니다.
      나. 쿠키의 설치∙운영 및 거부 : 웹브라우저 상단의 도구>인터넷 옵션>개인정보 메뉴의 옵션 설정을 통해 쿠키 저장을 거부 할 수 있습니다.
      다. 쿠키 저장을 거부할 경우 맞춤형 서비스 이용에 어려움이 발생할 수 있습니다.

9. 개인정보 보호책임자
LINA.PHOTOS는 개인정보 처리에 관한 업무를 총괄해서 책임지고, 개인정보 처리와 관련한 정보주체의 불만처리 및 피해구제를 처리하기 위하여 아래와 같이 개인정보 보호책임자를 지정하고 있습니다.
